This correspondence serves as notice that in accordance with the Kentucky Department for Libraries and Archives (KDLA) Public School Model records Retention Schedule, the Boone County Board of Education's adopted records retention schedule, Special Education Due Process Folders will be destroyed/purged three (3) years from the last activity of the student.

The Boone County School District would like to make parents/guardians, former students, and eligible (adult) students aware that Special Education records of students who graduated between May 2020 and May 2021 school years will be disposed of starting September 15, 2025.

Special Education records collected by the Boone County School District, relate to the identification, evaluation, educational placement, or the provision of Special Education in the district. In accordance with federal and state laws, these records must be maintained for a period of 3 years after Special Education Services have ended for the student. Special Education Services end when the student is no longer eligible for services, graduates or completes his or her educational program at age 22 or moves from the district.

This notification is solely to provide awareness to the students who graduated between May 2019 and May 2020 or who left school during those years. If no student, parent, or guardian responds to this public notice, the school district will assume consent to destroy all Special Educations records specific to the student after September 15, 2025. If the Student Services office does not receive notification of the intent to pick up the Due Process folder(s) and if the records are not picked up by September 15, 2025, the records will be shredded.
